Terms of service

GENERAL CONDITIONS (FOR SALE AND PURCHASE) 

As a user of Æon's site and services, the Buyers must read and understand these terms and conditions before purchasing. If the Buyers do not understand a particular provision of this document or disagree with one or more of them, they should contact a member of the Æon sales team before confirming the Purchase. Buyers can contact customer service by email at (contact@aeoncollection.fr). The Buyers who Confirm a purchase order are deemed to agree to Æon's terms and conditions. The Buyers should print a copy of these terms and conditions and read them carefully, as they are binding.

Contract Terms: the terms and conditions contained herein. 

ÆON SAS, a limited liability company with a capital of 1,000 euros, was registered in the Paris commercial register on 9 December 2024 under number 938 084 423 R.C.S.

Working days: any day of the week other than Saturday, Sunday, or any public holiday officially defined as such in France

CONTRACTUAL PROVISIONS

 

 The goods on sale are subject to an age restriction. By placing an Order, the Buyer represents it is 18 or older. 

The Buyers can check and correct any error before confirming an Order. 

Please check each step in the Order process before confirming it. 

Goods description: Æon endeavours to describe the Goods accurately to the best of its knowledge. Good descriptions are indicative and are not deemed to be a representation. Upon delivery, the Buyers shall inspect the Goods themselves during the cooling off period, after which any claim regarding the Good description shall be time-barred; furthermore, the Buyers shall keep Æon harmless for claims arising from description inaccuracies.

When the Buyers submit an Order, it represents an offer to purchase the Goods. However, this does not mean the Order is accepted and the Purchase is concluded. 

At its sole discretion, Æon may or may not confirm the acceptance of an Order by email (titled Order Confirmation). The full payment of the Goods is necessary but insufficient to conclude the sale; the contractual relationship between the parties shall not start before receipt of the Order confirmation. However, the ownership title shall remain in Æon's hands until the Goods are fully paid. Any Goods forming part of multiple Orders that have not been confirmed are excluded from the sale. The Goods appearing on Æon's Website are presented subject to availability. If Æon cannot supply the Goods (for example, if the Goods are no longer in stock), and the Buyers have already paid the Order. Æon will inform the Buyers by email that the Order is null and void. Æon shall refund the amount paid by the Buyer within seven working days of the nullity notification (unless there is sufficient reason to believe the Order was placed and paid for by fraudulent use of a bank card).

In some cases, goods shown on the Website are unavailable for dispatch until fully serviced (for example, the Goods may be awaiting service or a particular part when the Order is placed). Æon shall inform the Buyers of the Order confirmation and exercise due diligence in completing the service within a reasonable time, as well as respect any announced deadline, without prejudice to the Buyers' right to cancel the Order in the time frame granted by law.

The pictures of the Goods on the Website are for illustrative purposes only. Although Æon cares to present the Goods and the colours as accurately as possible, it cannot guarantee a true-to-life representation on the Buyers' screen, either in its resolution or colour management.

PRICE AND PAYMENT

The prices on the Website are expressed in Euros (€). Payments must be made in Euros (€), and refunds are also made in this same currency. When placing an order, the Buyers are deemed to assume the risk of exchange rate fluctuation between the Euro and their currency. Æon cannot be held liable for exchange rate variations affecting a purchase's final amount or a refund.

The prices may vary from time to time but can no longer be modified for Orders confirmed by Æon.

All prices include the VAT at the applicable rate for France at the time of the Order Confirmation. If the rate of VAT were to change between the date of the Order and Order and the date of delivery, the rate of VAT should be adjusted accordingly unless the Order Order is already fully paid.

The prices on the Website do not include delivery costs.

No delivery will be made until the full payment has been credited to the Æon designated bank account. Unless otherwise agreed, Æon accepts the following payment methods:

Debit card and credit card: card payments must be protected by 3D Secure technology;

Bank transfer: Æon will provide the Buyers with the bank details on the Order confirmation. Any banking transfer cost shall be charged to the Buyer's account.

In the event of a mutually agreed partial payment(s), and the balance is not received in full on the due date, Æon reserves the right to cancel the Order. By failing to pay the balance in due time, the Buyers shall waive their right to claim a refund of the deposits already made, and Æon may rightfully keep the deposit and place the Goods for sale on the Website Site, without prejudice of any claim Æon may have otherwise.

DELIVERY. 

Æon responsibility regarding deliveries shall cease upon releasing the Goods to the Buyer's carrier, without prejudice to the Buyer's right to return the Goods as per the terms herein.

Regardless of the liability for the Goods, ownership will shift to the Buyers only when the full payment amount has been credited to Æon's designated bank account.

 

THE ÆON'S SALES TERMS

Æon's sales are made on an as-is-where-is basis.

 RIGHT OF WITHDRAWAL 

The Buyers can exercise their right to withdrawal on its Order Order without justification. The withdrawal period expires 14 days after the day of delivery of the Goods. 

In the case of an Order for several goods, the period begins from the day of delivery of the last goods. To cancel your Order, Æon must be notified by email at (contact@aeoncollection.fr)

If the Order is cancelled, the Buyers will be fully refunded. Æon may reduce the refund amount for loss of value if negligent or faulty handling affects the value or integrity of the Goods. 

The Buyer must take reasonable care of the Good(s) and return it/them to Æon (along with their Documents, manuals, service papers, and boxes when applicable). The Goods must be in the same state as when delivered.

The Buyer knows that documents associated with a Good considerably increase its value and that their absence or damage substantially decreases it. If the Buyers cannot return the original Documents or return them in poorer condition, the estimated loss in value shall be rightfully deducted from the refund.

Æon staff inspects returned Goods. Any repair cost or loss of value resulting from Good(s) not being returned in its/their original condition beyond what is necessary to determine the nature, characteristics and operation of the Good(s) shall be for Buyer's account. Æon shall rightfully deduct the estimated repair cost and/or loss of value from the refund.

The Buyers shall care for the return shipment and its packaging,  which should be carried out under their supervision and responsibility and at their own cost. The Buyers assume all liabilities for any damage or delay that may affect the Good(s) and its/their return. As the case may be, the Buyers may seek remedies from the carrier; however, in no case can Æon be involved in a claim against the carrier who remains, in any event, the Buyers' servant.  

Buyers may exercise their withdrawal right by notifying Æon by email at (contact@aeoncollection.fr) within 14 days of receiving the Goods. Subject to compliance with the foregoing proviso, Æon will proceed with the refund within 14 days of receiving the returned Goods (s). Reimbursement will be made by bank transfer to the bank account used for payment. Any banking transfer cost associated with the refund will be charged to the Buyer's account.

Buyers have some protective rights as consumers. It is recommended that Buyers consult their rights with the local consumer protection service in their country. However, Buyers' consumer rights under their jurisdiction may not apply in France, as the sale and purchase contract herein is governed by French law.

ÆON RIGHT TO CANCELLATION 

Æon has the right to cancel an Order before delivery of the Goods, for example, in the case of an event beyond its control or of stock unavailability. Æon shall inform the Buyer as soon as possible should this occur. If Æon cancels an Order already paid for, it shall be refunded within seven working days (except in case of reasonable doubt of fraudulent card use)

FRAUDULENT PAYMENTS

Æon will not deliver a Good if it has sufficient reasons to believe that a fraudulent payment or fraudulent use of a payment card. No refund will be made before validation by Æon's bank.

CONFIDENTIALITY - RESPECT OF PRIVACY 

Æon attaches great importance to the protection of privacy. Æon makes every effort to minimize their collection, protect and secure personal data by the General Data Protection Regulation n°2016/679. Personal information is only used within the framework of our Privacy Policy.

ENTIRE AGREEMENT 

The terms of these general conditions (together with the documents to which they refer) constitute the entire contract. They cancel and replace any previous written or oral agreement relating to the parties' commercial relationship.

CHANGE OF TERMS AND CONDITIONS

Æon reserves the right to modify or revise its terms and conditions. Purchases are subject to the general conditions in force when the Buyer and Æon consent, except for changes imposed by law or by a competent authority (with retroactive effect on orders placed) or if we communicate a change to you before our sale confirmation.
